Supreme Court Nullifies Court of Appeal Decision on Nnamdi Kanu's Release

The Supreme Court overturned the Court of Appeal's ruling on Friday, December 15, revoking the order for the Federal Government to release Nnamdi Kanu, the embattled leader of the Indigenous People of Biafra (IPOB). This reversal came after the apex court upheld the federal government's appeal challenging the release order and directed Kanu to face the seven-count terrorism charges at the Federal High Court in Abuja.

In a unanimous decision by a five-member panel of Justices, the Supreme Court recognized the government's irresponsible action in forcefully repatriating Kanu from Kenya, yet maintained that the trial court retains jurisdiction over Kanu's case. Despite condemning the government's illegal action, the court emphasized the absence of legislation to strip the trial court of its jurisdiction, suggesting that Kanu's recourse would be through a civil action against the government.

Justice Garba Mohammed's prepared judgment, read by Justice Emmanuel Agim, emphasized the need for the government to be mindful of its image, both nationally and internationally. The court also criticized the trial court for revoking Kanu's bail after he fled his home following a security agents' invasion.

Nnamdi Kanu, arrested in 2015 and detained since June 2021, faces continued legal proceedings following the Supreme Court's decision, directing him to confront the charges against him at the Federal High Court in Abuja.
